This Privacy Policy describes how Side Projects ("we," "us," or "our"), operated by Fulcrum Enterprises s.r.o., collects, uses, discloses, and protects your personal data when you access or use the website at https://sideprojects.channel (the "Site"), including free editorial content and newsletter sign-ups.

We are the data controller for personal data collected through the Site (editorial content, newsletter). Merchandise purchases are processed by Fourthwall, Inc. as the Merchant of Record — see section 5. For privacy questions, contact us at contact@sideprojects.channel.

2. What Data We Collect

  • —Newsletter & contact data. Name (if provided), email address, consent timestamp, and IP address at the time of sign-up.
  • —Merchandise order data. Merchandise orders placed in the Side Projects store are processed by Fourthwall, Inc. as Merchant of Record. Fourthwall collects your shipping address, payment details, and order information directly. We may receive order status updates for customer service purposes.
  • —Technical / usage data. IP address, device and browser type, pages viewed, timestamps, referrer URLs.
  • —Cookies. Essential cookies for site operation; optional analytics cookies (if consented).
  • —Communications & support. Messages, emails, or support requests you send us.

3. Legal Bases for Processing (GDPR)

We process your data because:

  • —Legitimate interests. To secure the Site, analyze usage, detect abuse / fraud, and improve the service.
  • —Legal obligations. For accounting, tax, and regulatory compliance.
  • —Consent. For newsletter sign-ups, optional analytics, and any marketing communications.

4. How We Use Your Data

  • —Delivering, maintaining, and updating the Site.
  • —Sending newsletters and notifications you have opted into. You may opt out at any time.
  • —Monitoring and optimizing performance, security, and user experience.
  • —Responding to support requests and communications.

5. Disclosure, Sharing & Transfers

  • —Fourthwall, Inc. Fourthwall is the Merchant of Record for merchandise purchases made through the Side Projects store. They process payment, fulfillment, shipping, and post-sale support. Your purchase contract is with Fourthwall; Fourthwall's own privacy policy governs data collected during checkout.
  • —Third-party service providers. Hosting, analytics, email delivery, caching, and support tools — all under data-processing agreements.
  • —Legal / regulatory authorities. If required by law or to enforce our rights.

Some providers operate outside the EEA. In such cases, we rely on EU Commission adequacy decisions or standard contractual clauses to protect your personal data.

6. Data Retention

  • —Newsletter sign-ups. Retained for as long as you remain subscribed, plus the period necessary to evidence your consent.
  • —Technical logs & analytics. Retained for up to 12 months, then anonymized where possible.
  • —Order-status updates. When we receive an order-status update for customer service, we retain it only while needed to resolve the support request and any legal claims, after which it is deleted or anonymized.
  • —Communications & support records. Kept as long as necessary to resolve issues or legal claims.

7. Your Rights (Under GDPR / Czech Law)

You can:

  • —Request correction of inaccuracies.
  • —Ask for erasure (delete) of your data, subject to legal constraints.
  • —Request restriction of, or object to, processing.
  • —Receive your data in a portable format.
  • —Withdraw consent at any time (without affecting processing done before withdrawal).
  • —Lodge a complaint with the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů).

8. California Residents (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) gives you rights with respect to the personal information we collect about you. These rights overlap substantially with the GDPR-style rights listed above, and include the right to know, the right to access and portability, the right to correct, and the right to delete your personal information.

In addition, the CCPA gives you the right to opt out of any "sale" or "sharing" of your personal information. We do not sell personal information for money. To the extent any of our advertising or analytics integrations are considered "sharing" for cross-context behavioral advertising under the CCPA, you can opt out by emailing contact@sideprojects.channel or by enabling the Global Privacy Control signal in your browser.

California's "Shine the Light" law: we do not disclose your personal information to third parties for their own direct marketing purposes.

9. Children's Privacy

The Site is not directed to children. We do not knowingly collect personal information from anyone under 16 (the threshold under the GDPR) or under 13 (the threshold under the U.S. Children's Online Privacy Protection Act). If you believe a child has provided us with personal information, contact us at contact@sideprojects.channel and we will delete it.

10. Cookies & Tracking

We employ:

  • —Analytics cookies. For aggregated usage and performance metrics (where you have given consent).

We honor the Global Privacy Control (GPC) signal as a valid opt-out request for any processing that would otherwise be treated as "sale" or "sharing" of personal information under the CCPA.
